Welcome to Military Doula Trainings, LLC (“Military Doula Trainings,” “MDT,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of the Military Doula Trainings, LLC website, online learning platform, courses, workshops, educational programs, mentorship opportunities, resources, digital materials, communications, and related services (collectively, the “Services”).

By accessing our website, creating an account, registering for a course or program, purchasing a product or service, downloading materials, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

If you do not agree to these Terms, you may not access or use the Services.

These Terms are intended to replace and supersede any prior website Terms of Use applicable to Military Doula Trainings LLC, to the extent permitted by law.

ABOUT MILITARY DOULA TRAININGS, LLC

Military Doula Trainings, LLC is an educational and professional development platform designed to provide military-focused education, training, resources, mentorship, and business support for professionals serving military-connected families.

Our programs may include education and training for:

  • Labor and birth professionals;

  • Doulas and perinatal professionals

  • Military spouses seeking professional education or career opportunities;

  • Healthcare professionals and healthcare organizations;

  • Community organizations;

  • Individuals seeking education related to supporting military-connected families; and

  • Other professionals or organizations participating in MDT programs.

Military Doula Trainings is an independent educational business and is not a branch, agency, department, or official representative of the United States Department of War, any branch of the United States Military, or any military installation unless expressly stated otherwise in writing.

Participation in a Military Doula Trainings program does not create an employment, contractor, military, government, or healthcare-provider relationship between the participant and Military Doula Trainings.

ELIGIBILITY

You must be at least eighteen (18) years old to purchase or enroll independently in our Services unless a particular program expressly permits participation by a minor with the consent of a parent or legal guardian.

By using the Services, you represent and warrant that:

  1. You are legally capable of entering into a binding agreement;

  2. The information you provide is accurate and complete;

  3. You will maintain the accuracy of your account information;

  4. You will use the Services only for lawful purposes; and

  5. You will comply with these Terms and all applicable laws and regulations.

We reserve the right to refuse enrollment or access where permitted by law.

ACCOUNTS AND ACCOUNT SECURITY

Certain Services may require you to create an account.

You agree to provide accurate, current, and complete information when creating an account and to update that information when necessary.

You are responsible for:

  • Maintaining the confidentiality of your username and password;

  • All activity occurring through your account;

  • Not sharing your login credentials with another person;

  • Not allowing another person to access paid course content through your account; and

  • Notifying Military Doula Trainings promptly if you believe your account has been accessed without authorization.

Course access is personal to the registered participant unless Military Doula Trainings expressly authorizes otherwise.

We may suspend or terminate accounts that are used in violation of these Terms.

EDUCATIONAL SERVICES

Military Doula Trainings provides educational and professional-development content.

Programs may include live instruction, prerecorded lessons, digital manuals, downloadable materials, assignments, discussions, resource lists, mentorship, office hours, workshops, assessments, or other educational activities.

Specific course requirements, schedules, prerequisites, completion requirements, materials, fees, and access periods may vary by program.

The terms presented on the applicable registration page, enrollment agreement, course description, or written program materials may contain additional requirements specific to that program.

Where a program-specific agreement conflicts with these Terms, the program-specific agreement will control with respect to that particular program.

TRAINING, CERTIFICATION, AND CREDENTIALING

Enrollment in a Military Doula Trainings, LLC. course does not automatically guarantee certification, credentialing, employment, reimbursement, insurance participation, military installation access, or acceptance by any governmental, military, healthcare, insurance, educational, or professional organization.

Where a program is associated with an outside certifying organization, Military Doula Trainings will identify that relationship in the applicable course materials.

Participants are responsible for completing all requirements established by the applicable certifying organization, including requirements that may exist outside of Military Doula Trainings.

Military Doula Trainings does not guarantee that completion of any course will result in certification, employment, referrals, reimbursement, or income.

CAPPA AND OTHER THIRD-PARTY ORGANIZATIONS

Where Military Doula Trainings provides training associated with the Childbirth and Postpartum Professional Association (“CAPPA”) or another third-party organization, the participant understands that the third-party organization's policies, requirements, standards, fees, certification requirements, and terms may apply.

Military Doula Trainings does not control the policies or decisions of independent third-party organizations.

A participant's completion of an MDT course does not override or replace requirements imposed directly by a third-party certifying or accrediting organization.

Participants are responsible for reviewing the current requirements of any outside organization relevant to their certification or professional practice.

MILITARY SPOUSE EDUCATION, FUNDING, AND SPOUSEWORKS

Certain Military Doula Trainings programs may be eligible for funding or reimbursement through military-affilated education programs, including programs administered by third parties.

Eligibility for funding is determined by the applicable funding organization, not Military Doula Trainings.

Military Doula Trainings does not guarantee:

  • Eligibility for SpouseWorks or another funding program;

  • Approval of an Education and Training Plan;

  • Continued availability of funding;

  • Reimbursement of tuition;

  • Payment by a funding provider; or

  • Approval of a particular course or program by a funding provider.

Participants are responsible for completing all required paperwork and obtaining applicable approvals before enrollment where required.

If a participant is relying on third-party funding, the participant remains responsible for understanding the terms of that funding arrangement.

EMPLOYMENT AND MENTORSHIP OPPORTUNITIES

Military Doula Trainings may provide mentorship, networking, employment resources, referrals, business education, or introductions to organizations seeking qualified professionals.

These opportunities are provided as educational or networking resources unless a separate written employment or contractor agreement states otherwise.

Military Doula Trainings does not guarantee employment, contracts, clients, income, referrals, military installation access, or placement.

Any employment, independent-contractor, referral, or mentorship relationship established with a third party is between the participant and that third party and may be subject to separate terms.

Participants are responsible for evaluating any employment or contractor opportunity before accepting it.

FEES, PAYMENT, AND ENROLLMENT

Course and program pricing will be displayed at the time of enrollment unless otherwise stated.

Enrollment is not considered complete until payment has been successfully processed or an approved payment arrangement or third-party funding authorization has been received, as applicable.

Military Doula Trainings may offer:

  • Full-payment options;

  • Payment plans;

  • Deposits;

  • Scholarships or discounts;

  • Third-party funding;

  • Promotional pricing; or

  • Other payment arrangements.

Specific payment terms applicable to a program will be disclosed during enrollment.

Military Doula Trainings reserves the right to correct pricing errors or other obvious administrative errors, subject to applicable law.

PAYMENT PLANS AND RECURRING PAYMENTS

If you voluntarily enroll in a payment plan or recurring payment arrangement, you authorize Military Doula Trainings or its designated payment processor to charge the payment method according to the terms disclosed at enrollment.

Before enrollment in a recurring payment arrangement, the applicable price, payment frequency, duration, and other material terms will be disclosed.

You are responsible for maintaining a valid payment method.

If a payment fails, Military Doula Trainings may suspend access to paid Services until the account is brought current, subject to applicable law and the terms of the applicable program.

If you enroll in a recurring subscription or membership, cancellation procedures will be provided with the applicable offer. Cancellation will be handled in accordance with applicable law.

CANCELLATION, TRANSFERS, AND REFUNDS

Unless a specific course or enrollment agreement states otherwise, all sales are subject to the cancellation and refund policy presented at the time of purchase.

Because many Military Doula Trainings programs involve limited enrollment, instructor preparation, digital materials, course access, and reserved educational capacity, deposits and tuition may be non-refundable where clearly disclosed before purchase and permitted by law.

Where permitted, Military Doula Trainings may allow a participant to transfer enrollment to another eligible course, cohort, or date.

Transfers are not guaranteed and may be subject to availability, deadlines, administrative requirements, or additional fees.

Military Doula Trainings reserves the right to establish program-specific cancellation and transfer policies.

Nothing in this section limits rights that cannot legally be waived.

COURSE ACCESS

Unless otherwise stated, access to digital course materials is provided only to the registered participant and for the period specified for the applicable course.

You may not:

  • Share your login credentials;

  • Allow another person to access your course;

  • Copy an entire course;

  • Resell course access;

  • Upload course materials to another platform;

  • Distribute course materials to another person;

  • Record live instruction without written permission;

  • Share private course links;

  • Circumvent technical access restrictions; or

  • Use course materials to create a competing training program without written authorization.

Military Doula Trainings may suspend or terminate course access if unauthorized sharing or distribution is discovered.

INTELLECTUAL PROPERTY

All materials made available through the Services, including but not limited to:

  • Course manuals;

  • Presentations;

  • Videos;

  • Audio recordings;

  • Worksheets;

  • Graphics;

  • Logos;

  • Website content;

  • Training frameworks;

  • Curriculum;

  • Assessments;

  • Resource lists;

  • Downloadable materials;

  • Written materials;

  • Educational content;

  • Course organization and structure; and

  • Other original materials

are owned by Military Doula Trainings or its licensors unless otherwise identified.

Your purchase of a course provides you with a limited, non-exclusive, non-transferable right to access and use the course materials for your own personal educational and professional development.

Your purchase does not transfer ownership of the underlying intellectual property.

You may not reproduce, modify, publish, distribute, sell, license, sublicense, publicly display, publicly perform, create derivative works from, or commercially exploit MDT materials without prior written permission.

PARTICIPANT MATERIALS AND USER CONTENT

Certain Services may allow participants to submit comments, assignments, testimonials, photographs, videos, feedback, reviews, questions, discussion posts, or other materials (“User Content”).

You retain ownership of User Content that you independently create, subject to the rights granted below.

By submitting User Content to Military Doula Trainings for publication, educational use, community discussion, or other Services, you grant Military Doula Trainings a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and format that User Content solely for purposes related to operating, promoting, improving, or providing the Services.

You represent that you have the right to submit the User Content and that doing so does not violate another person's rights.

Military Doula Trainings will not knowingly represent another person's work as its own.

You may not submit confidential, proprietary, copyrighted, or personally identifying information belonging to another person unless you have appropriate authorization.

REVIEWS AND TESTIMONIALS

We welcome honest feedback about Military Doula Trainings.

Nothing in these Terms is intended to prohibit or penalize a participant from providing an honest review or opinion about our Services.

You may not knowingly submit fraudulent, deceptive, defamatory, impersonating, or materially misleading content.

If you voluntarily provide a testimonial or authorize Military Doula Trainings to use your testimonial for marketing, we may use it in accordance with the permission provided.

Military Doula Trainings will not condition a refund or benefit on the requirement that you provide a positive review.

PRIVACY

Your use of the Services is also subject to our Privacy Policy.

The Privacy Policy explains how Military Doula Trainings collects, uses, stores, and protects information submitted through the website and Services.

Military Doula Trainings provides educational and professional-development information.

Unless expressly identified otherwise, our educational materials are not medical care and are not intended to diagnose, treat, prevent, or cure any medical condition.

Information provided through our Services should not be considered a substitute for individualized medical, clinical, legal, mental-health, financial, or other professional advice.

Birth professionals, doulas, healthcare professionals, and other participants are responsible for practicing within the scope of their education, training, certification, licensure, applicable law, professional standards, and employer or organizational policies.

Participants are responsible for obtaining appropriate professional advice when necessary.

Military Doula Trainings does not direct the medical care of any client or patient.

NO GUARANTEE OF PROFESSIONAL RESULTS

Participation in our training does not guarantee:

  • Employment;

  • Clients;

  • Business income;

  • Certification;

  • Licensure;

  • Insurance reimbursement;

  • TRICARE participation;

  • Military installation access;

  • Government contracts;

  • Healthcare facility contracts;

  • Referrals;

  • A specific level of professional success; or

  • Any particular financial result.

Professional outcomes depend on numerous factors outside Military Doula Trainings' control.

TRICARE, MILITARY PROGRAMS, AND GOVERNMENT BENEFITS

Military Doula Trainings may provide educational information concerning TRICARE, military healthcare systems, military spouse programs, military family resources, or other government programs.

Such information is provided for educational purposes and may change.

Government programs, regulations, reimbursement policies, contractor requirements, eligibility rules, and benefit structures are outside the control of Military Doula Trainings.

Participants should verify current requirements directly with the applicable government agency, contractor, healthcare organization, or program administrator before relying on such information.

Military Doula Trainings does not guarantee reimbursement, participation, eligibility, or approval under any government program.

THIRD-PARTY WEBSITES, SERVICES, AND PARTNERS

Our website and educational materials may contain links to third-party websites, organizations, service providers, payment processors, educational organizations, military resources, healthcare organizations, or other external services.

Military Doula Trainings does not control third-party websites or services.

We are not responsible for:

  • Their content;

  • Privacy practices;

  • Security;

  • Availability;

  • Accuracy;

  • Terms;

  • Policies; or

  • Services.

Your use of a third-party service is subject to that third party's terms and policies.

ACCEPTABLE USE

  10. Submit fraudulent information;

  13. Engage in conduct that materially interferes with another participant's ability to use the Services.

COMMUNITY PARTICIPATION

Where MDT provides discussion groups, online communities, mentorship spaces, live sessions, or other participant forums, participants are expected to communicate professionally and respectfully.

Military Doula Trainings may remove content or restrict access when reasonably necessary to protect participants, instructors, staff, partners, or the integrity of the Services.

We do not guarantee that all participant-generated content is accurate or endorsed by Military Doula Trainings.

Participants remain responsible for their own statements and contributions.

RECORDING OF LIVE TRAINING

Military Doula Trainings may record certain live training sessions for educational, administrative, quality-control, or participant-access purposes.

Where a session will be recorded, participants may be notified in advance.

Participants may not independently record, reproduce, distribute, livestream, or publish MDT training sessions without written authorization.

If you do not wish to appear in a recording, please follow the participation instructions provided for that specific session.

CONFIDENTIALITY

Participants may receive confidential or proprietary information through courses, mentorship, partner programs, or professional discussions.

Participants agree not to knowingly disclose another participant's confidential personal, business, financial, medical, employment, or proprietary information.

This provision does not prohibit disclosures required by law or information that is independently available to the public.

DISCLAIMERS AND WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

MILITARY DOULA TRAININGS DOES NOT WARRANT THAT:

  • THE SERVICES WILL ALWAYS BE AVAILABLE;

  • THE WEBSITE WILL BE ERROR-FREE;

  • COURSE MATERIALS WILL ALWAYS BE FREE FROM ERRORS OR OMISSIONS;

  • INFORMATION WILL ALWAYS BE CURRENT;

  • THE SERVICES WILL MEET EVERY USER'S EXPECTATIONS; OR

  • ANY PARTICULAR PROFESSIONAL, FINANCIAL, CERTIFICATION, EMPLOYMENT, OR BUSINESS RESULT WILL OCCUR.

WE DISCLAIM WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILITARY DOULA TRAININGS, ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, CONSULTANTS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITY, LOSS OF DATA, LOSS OF CLIENTS, OR OTHER ECONOMIC LOSS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MILITARY DOULA TRAININGS ARISING FROM OR RELATED TO A PARTICULAR SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO MILITARY DOULA TRAININGS FOR THAT SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

This limitation does not apply to liability that cannot legally be limited or excluded.

INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Military Doula Trainings and its owners, officers, employees, contractors, instructors, consultants, affiliates, and representatives from claims, liabilities, damages, losses, costs, and reasonable attorneys' fees arising from:

  1. Your violation of these Terms;

  2. Your misuse of the Services;

  3. Your violation of another person's rights;

  4. Your User Content;

  5. Your unauthorized use or distribution of MDT materials; or

  6. Your violation of applicable law.

This provision does not require you to indemnify Military Doula Trainings for its own conduct to the extent prohibited by applicable law.

COPYRIGHT INFRINGEMENT / DMCA

Military Doula Trainings respects the intellectual property rights of others.

If you believe that material available through our Services infringes your copyright, you may submit a written notice containing sufficient information for us to identify the copyrighted work, the allegedly infringing material, your contact information, and the required good-faith and authorization statements under applicable law.

TERMINATION AND SUSPENSION

Military Doula Trainings may suspend or terminate your access to all or part of the Services if:

  • You provide fraudulent or misleading information;

  • You share or distribute course materials without authorization;

  • You interfere with the Services;

  • You engage in abusive or threatening conduct;

  • You fail to make required payments; or

  • Suspension or termination is otherwise necessary to protect the Services, participants, or business.

Where appropriate, we may provide notice and an opportunity to correct the violation.

Termination does not eliminate obligations that by their nature should survive termination, including intellectual property, confidentiality, limitations of liability, indemnification, and dispute provisions.

CHANGES TO THE SERVICES

Military Doula Trainings may modify, update, replace, suspend, or discontinue portions of the Services.

Course schedules, instructors, platforms, technology, resources, and program structures may change when reasonably necessary.

Where a material change substantially affects a paid program, Military Doula Trainings will make reasonable efforts to provide appropriate notice and, where applicable, a reasonable alternative.

CHANGES TO THESE TERMS

We may update these Terms from time to time.

When we make material changes, we may provide notice through the website, email, account notification, or another reasonable method.

The updated Terms will identify a new “Last Updated” date.

Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by law.

ELECTRONIC COMMUNICATIONS AND SIGNATURES

By using the Services, you agree to receive communications electronically, including emails concerning:

  • Course enrollment;

  • Payments;

  • Course schedules;

  • Program changes;

You are responsible for maintaining an active email address associated with your account.

MARKETING COMMUNICATIONS

You may receive marketing communications from Military Doula Trainings if you voluntarily subscribe to them.

You may unsubscribe from promotional email communications using the unsubscribe mechanism provided in the communication.

Unsubscribing from marketing communications does not prevent us from sending necessary transactional or administrative communications related to a course, account, payment, or other Service.

FORCE MAJEURE

Military Doula Trainings will not be responsible for delays or inability to perform caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters;

  • Hurricanes;

  • Severe weather;

  • Fire;

  • Flood;

  • Epidemic or pandemic;

  • Government action;

  • Military operations;

  • War;

  • Civil unrest;

  • Labor disputes;

  • Internet or telecommunications failures;

  • Platform or technology failures;

  • Power outages; or

  • Other circumstances beyond our reasonable control.

Where reasonably possible, Military Doula Trainings may reschedule affected programs or provide an alternative method of delivery.

INDEPENDENT CONTRACTORS

Nothing in these Terms creates a partnership, joint venture, employment relationship, franchise relationship, or agency relationship between you and Military Doula Trainings.

Unless expressly stated in a separate written agreement, instructors, mentors, consultants, partner organizations, and other professionals may operate as independent contractors or independent entities.

No participant is authorized to represent that they are an employee, agent, partner, or official representative of Military Doula Trainings unless expressly authorized in writing.

MILITARY AND GOVERNMENT AFFILIATION

Military Doula Trainings may work with military-connected organizations, military spouses, veterans, healthcare providers, nonprofit organizations, government programs, military-family organizations, or other entities.

Unless expressly stated otherwise, such relationships do not mean that Military Doula Trainings is owned, operated, endorsed, sponsored, or officially affiliated with the United States Government or the United States Department of War.

The use of military-related terminology, educational resources, or references to military programs does not itself establish official government affiliation.

GOVERNING LAW

DISPUTE RESOLUTION

Before filing a formal legal action, the parties agree to make a good-faith effort to resolve disputes informally.

A party seeking to raise a dispute should provide written notice describing:

  1. The nature of the dispute;

  2. The relevant facts;

  3. The requested resolution; and

  4. Contact information for further communication.

The parties will make reasonable efforts to resolve the dispute before pursuing formal proceedings.

Nothing in this section prevents either party from seeking emergency injunctive or equitable relief where legally appropriate.

SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where legally permitted.

The remaining provisions will remain in full force and effect.

WAIVER

Failure by Military Doula Trainings, LLC to enforce any provision of these Terms does not constitute a waiver of the right to enforce that provision or any other provision in the future.

Any waiver must be made by an authorized representative of Military Doula Trainings.

ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without prior written consent from Military Doula Trainings, LLC.

Military Doula Trainings, LLC may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, corporate restructuring, or other lawful business transaction.

ENTIRE AGREEMENT

These Terms, together with any applicable:

  • Enrollment Agreement;

  • Course-specific terms;

  • Payment agreement;

  • Refund/cancellation policy;

  • Privacy Policy;

  • Website policies;

  • Written partnership agreement; and

  • Other written terms expressly incorporated by reference

constitute the agreement between you and Military Doula Trainings, LLC concerning your use of the Services.

If a specific written agreement conflicts with these Terms, the specific agreement will control with respect to the subject matter addressed in that agreement.
